General terms and conditions

These General Terms and Conditions apply between Blueteesgolf.eu (we/us) and you as a customer/consumer of Blueteesgolf.eu. By visiting our website and placing an order you expressly agree to the contents of these General Terms and Conditions and our Privacy Statement . These Terms and Conditions shall apply to each Order and to each Agreement concluded.

Article 1 - Definitions

In these General Conditions the following definitions shall apply:

• General Terms and Conditions: these General Terms and Conditions of Blueteesgolf.eu.
• Article: an article of these General Terms and Conditions.
• Grace period: the period within which you, the Consumer, can exercise your right of withdrawal;
• Order: an order from the Consumer of Products from Blueteesgolf.co.uk as described in Article 2;
• Consumer: you as a natural person not acting in the exercise of a profession or business and entering into an agreement with Blueteesgolf.co.uk;
• Day: calendar day;
• Right of withdrawal: the legal possibility to cancel your agreement with Blueteesgolf.co.uk within the cooling-off period;
• Model form: the model form for withdrawal that we make available to you when you wish to exercise your right of withdrawal as a Consumer.
• Agreement: a purchase agreement concluded between the Consumer and Blueteesgolf.co.uk whereby you place an order for Product(s) on the Website and Blueteesgolf.co.uk delivers the Products as described in Article of the General Terms and Conditions;

Article 2 - Order and establishment of the Agreement

1. A description, offer or quotation of a Product shall not constitute an Order with Blueteesgolf.co.uk. Blueteesgolf.eu may change a description, offer or quotation of a Product at any time.
2. Offers are valid while supplies last.
3. An Order implies the following:
   1. You as a Consumer have entered your details on the appropriate entry screen of the Website and sent the relevant data ("order form") to Blueteesgolf.co.uk electronically, which Blueteesgolf.eu must have received, or
   2. You, the Consumer, have expressly stated by telephone or e-mail that you wish to receive a certain Product.
4. An Agreement comes into effect when an order confirmation of the Order is sent to you by e-mail to the e-mail address provided by you. The Agreement may be revoked by Blueteesgolf.eu in case you do not comply with the (payment) conditions. In that case Blueteesgolf.co.uk shall notify you as a Consumer within ten (10) days after receipt of the Order.
5. By making use of electronic forms of communication, such as via the Website, a valid (purchase) agreement is concluded. The electronic files of Blueteesgolf.co.uk shall, to the extent permitted by law, serve as a presumption of evidence.
6. Information, images, oral notifications, statements, etc. regarding all offers and the main characteristics of the Products provided by telephone or e-mail shall be as accurate as possible. Unfortunately Blueteesgolf.co.uk cannot guarantee that all offers and Products are completely in accordance with the information provided. Deviations may in principle not give rise to damages and/or dissolution.
7. If we are unable to meet the delivery deadline of 30 days, you, the consumer, have the right to terminate the agreement. You will have to contact Blueteesgolf.co.uk yourself (by e-mail) to do so.

 

Article 3 - Price & Payment

1. The prices of the Products are expressed in Euros and include sales tax (VAT).
2. You shall owe the price stated in the order confirmation of Blueteesgolf.eu on the basis of the Agreement. Obvious mistakes/errors may be corrected by Blueteesgolf.co.uk even after the conclusion of the Agreement. We shall not be obliged to deliver the Product according to the incorrect price.
3. Delivery costs are not included in the price of the Products but are stated separately on the checkout screen of the Website.
4. Price increases are permitted within 3 months of the conclusion of the Agreement only if they result from legal regulations or provisions.
5. Payment of the Order(s) can be made in the following ways, among others:
   1. Ideal
   2. Credit card (VISA, Mastercard)
   3. Sofort bank transfer
   4. After pay option
   5. Gift card
6. When paying by credit card, the terms and conditions of the card issuer apply. Blueteesgolf.eu is not a party in the relationship between you and the card issuer.
7. If you fail to pay the invoice for your order(s) on time, you are immediately in default as a Consumer. In that case Blueteesgolf.eu is entitled to charge reasonable and extrajudicial costs to ensure payment of the invoice.

 

Article 4 - Delivery & execution

1. Orders will be delivered as soon as possible. In principle Blueteesgolf.eu strives to ship Orders placed before 22:00 on a business day on the same day. The ultimate delivery period is 30 days after receipt of the Order. Mentioned delivery times are indicative only. No rights can be derived from them.
2. When you order a Product that is temporarily out of stock, Blueteesgolf.eu will notify you and indicate when the Product will be available again.
3. If the delivery is delayed, or if an order cannot or can only be partially carried out, you will be notified within 30 days after you have placed the order. In that case, you have the right, as a Consumer, to dissolve the Agreement free of charge. You are in that case not entitled to damages. Blueteesgolf.eu will refund the amount you have paid as soon as possible and no later than 14 days after cancellation.

 

1. Deliveries will be made to the address provided by you.
2. Once the ordered Products have been delivered to the specified delivery address, the risk in these Products shall pass to you as the Consumer.
3. Different terms and conditions may apply to deliveries abroad.
4. If the delivery takes place in parts, Blueteesgolf.co.uk shall be entitled to consider each delivery as a separate Agreement.

 

Article 5 - Right of withdrawal & costs

1. When purchasing Products, you have the possibility of dissolving the Agreement without giving reasons for a period of 14 days (the right of withdrawal). This cooling-off period commences on the day following receipt of the Product.
2. During the withdrawal period you as a Consumer will handle the Product and its packaging with care. When you wish to exercise your right of withdrawal, the Product must be returned with all delivered accessories and - if possible - in the original condition and packaging to Blueteesgolf.co.uk, in accordance with the provided (return) instructions.
3. If you wish to make use of your right of withdrawal, you must inform us of this within 14 days after receipt of the Product. You can make this known via the model form. After sending this form, the Product must be returned within 14 days. The burden of proof rests with you.
4. If you do not timely fill in the model form or return the Product, the purchase is final and the Product(s) must be paid for in full.
5. You are responsible for the costs of the return shipment after revocation.
6. If you have already paid an amount, Blueteesgolf.eu will refund this amount as soon as possible and at the latest within 14 days after withdrawal. This is subject to the condition that the Product has been received back in the meantime or proof of complete return can be provided. The refund will be made via the same payment method unless you expressly consent to another payment method.
7. If the Product is damaged due to careless handling by you, you as the Consumer will be liable for any decrease in value of the Product.

 

Article 6 - Conformity & Warranty

1. In principle, the warranty applicable to the Products delivered by Blueteesgolf.eu shall be as determined by the manufacturer of the Product concerned. If the Product does not comply with the Agreement, you must notify Blueteesgolf.co.uk within a period of two months after discovery thereof.
2. co.uk shall never be obliged to pay damages, unless in the event of intent or gross negligence on its part. Blueteesgolf.eu does not accept any liability for consequential damage, indirect damage, loss of profits or turnover.
3. If Blueteesgolf.eu is obliged to compensate any damage for whatever reason, this compensation shall never exceed an amount equal to the invoice value of the Product.
4. Without prejudice to the provisions of this Article, no warranty may be given in the following cases:
   1. If wear and tear can be considered normal;
   2. If changes have been made to the Product, including repairs not authorized by Blueteesgolf.eu or the manufacturer;
   3. If the original invoice cannot be presented, has been altered or made illegible;
   4. If defects are the result of improper or inappropriate use;
   5. If damage is caused by intent, gross negligence or negligent maintenance.
5. co.uk may include on its internet site links to other internet sites that may be interesting or informative for the Consumer. Such links are purely informative. Blueteesgolf.eu is not responsible for the content of the Internet site referred to or the use thereof.
6. Demonstration models may be subject to a reduced warranty.

 

1. When investigation costs are incurred to discover a defect of the Product or part of the Product, which is excluded from the warranty, these costs shall always be borne by you, the Consumer. Blueteesgolf.eu strives to notify you in advance. The absence of such notification does not relieve you of the obligation to pay these costs.

 

Article 7 - Complaints procedure

1. If you have any complaints about Blueteesgolf.eu, please contact us within one week at blueteesgolfsupport@spanishhands.com.
2. We will process your complaint as soon as possible and we will do our best to handle your complaint within two weeks after receipt.

 

Article 8 - Personal data

1. co.uk will only process your data in accordance with its privacy policy. The internet site contains a Privacy Statement.
2. co.uk will comply with the applicable laws and regulations.

 

Article 9 - Disputes

1. Agreements to which these General Conditions apply are exclusively governed by Dutch law. Even if you reside abroad.
2. The Vienna Sales Convention is not applicable.

 

Article 10 - Additional provisions

1. Ownership of the Products shall not pass to you as a Consumer until you have paid in full all amounts due to you under the Agreement with Blueteesgolf.co.uk, including payment of any interest and costs, even of earlier or later deliveries and any work performed or to be performed with respect to the Products.
2. You expressly acknowledge that all intellectual property rights of displayed information, announcements or other expressions relating to the Products and/or the Website belong to Blueteesgolf.eu, its suppliers or other entitled parties.
3. Intellectual property rights mean patent, copyright, trademark, design and model rights and/or other (intellectual property) rights, including patentable or non-patentable technical and/or commercial know-how, methods and concepts.
4. No image on this website may be reproduced or published in any form or by any means, electronic, mechanical, or otherwise, without the prior written permission of Blueteesgolf.eu.
5. It is prohibited to use and/or modify the intellectual property rights as described in this Article, for example reproduction without the express prior written consent of Blueteesgolf.eu, its suppliers or other right holders, unless it is for private use only.
6. co.uk takes the utmost care with this website and the reliability and topicality of the data it contains. Despite all care, inaccuracies and incompleteness cannot always be avoided. Blueteesgolf.eu is not liable for errors or inaccuracies. Of course, as soon as we notice an error or inaccuracy, we will correct it as soon as possible.
7. Photos and descriptions of Products on this site are as accurate as possible and are intended to give you a good impression of the Products. Unfortunately we cannot guarantee that all Products described are available or in stock at all times, unless Blueteesgolf.eu explicitly guarantees this. This also applies to the accuracy of stated prices and offers of the Products.
8. co.uk therefore always retains the option to cancel an Order and refund the amount due if Products and descriptions are incorrectly stated.
